These Terms and Conditions ("Terms") govern your access to and use of WordPress Static Shield from Tulapp, including any software, plugins, hosted services, dashboards, APIs, remote services, integrations, monitoring, security functionality, performance functionality, management tools, updates and related services made available by Tulapp (collectively, the "Service").
By creating an account, installing or activating software, connecting a website, using hosted functionality, purchasing a subscription, or otherwise using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
The Service is provided by Tulapp, a trade name of ClickSmash B.V., registered in the Netherlands under KVK number 93178085 (VAT NL866302566B01), registered address Grote Sparrenlaan 3, 2121 CZ Bennebroek, The Netherlands.
References to "Tulapp", "we", "us" or "our" include ClickSmash B.V. and, where legally relevant, its employees, contractors, developers and licensors.
The Service provides software and online functionality intended to assist users in operating, managing, optimising, protecting, monitoring, publishing or otherwise working with websites and related technical infrastructure.
The Service may include local software, hosted functionality, automated processes, remote services, third-party integrations and other technical features.
Available functionality may differ depending on:

The Service may include functionality intended to improve security, reduce exposure, identify risks or help users manage technical systems.
No software or security measure can guarantee complete security.
Tulapp does not guarantee that the Service will:
Security-related scores, statuses, warnings, classifications and recommendations are informational tools and not guarantees.
You remain responsible for the security and management of your systems.
You use the Service at your own risk.
The Service may interact with, modify or influence technical components of your website or infrastructure.
Depending on configuration, this may affect matters such as:
Software defects, configuration errors, incompatibilities, third-party changes or unexpected technical conditions may cause a website or part of a website to malfunction or become unavailable.
Before using functionality that may affect a website, configuration, files, database, access controls or infrastructure, you must maintain an appropriate and restorable backup.

Where the Service asks you to confirm that a backup exists, Tulapp does not independently verify that the backup is complete or restorable.
Unless expressly agreed otherwise in a separate service agreement, Tulapp is not responsible for maintaining backups on your behalf.
You must maintain sufficient technical or administrative access to recover your website or infrastructure if something goes wrong.
This may include access to hosting, files, databases, DNS, server management tools, backup systems or other relevant infrastructure.
Do not activate technical functionality if you are unable to recover from an unsuccessful configuration change or deployment.
The Service may support older or outdated software in certain circumstances.
Compatibility with outdated software does not mean that such software is safe, supported by its original vendor, or free from vulnerabilities.
The Service may reduce certain forms of exposure, but users remain responsible for updating, replacing, patching or otherwise maintaining outdated software where reasonably possible.
The Service operates in technical environments that may contain software and services outside Tulapp's control.
Tulapp therefore does not guarantee compatibility with every:
Compatibility information provided by the Service may be based on testing, observed behaviour, known technical information, aggregated data or automated analysis.
Such information is provided as guidance and does not constitute a warranty.
You are responsible for testing important functionality before relying on it in production.
Where the Service provides preview, validation, staging, rollback or similar functionality, such tools are intended to reduce risk but do not eliminate the need for appropriate testing and backups.
Some functionality may require a Tulapp account.
You are responsible for:
Tulapp may require account or email verification.
We may provide account, password or access recovery mechanisms.
Recovery mechanisms are provided as a convenience and security measure but cannot be guaranteed to work in every technical situation.
You remain responsible for maintaining independent access to systems you manage.
The Service may allow users to remotely configure or manage connected websites or infrastructure.
Where remote access controls or restrictions are used, configuration changes may affect your ability to access your own systems.
You are responsible for reviewing and maintaining appropriate recovery options.
Tulapp does not guarantee that remote recovery will always be possible.
Where access controls depend on network addresses, devices, authentication state or similar technical characteristics, changes in those characteristics may affect access.
For example, internet providers, mobile networks and VPN services may change IP addresses.
The Service may provide mechanisms to update or recover access, but you should maintain an independent recovery method where reasonably possible.
Certain parts of the Service may be hosted by Tulapp or third parties.
Hosted services may process technical information required to provide functionality.
Availability may depend on:
Tulapp does not guarantee uninterrupted availability.
Where technically possible, functionality deployed locally to a customer's website or infrastructure may continue operating independently of Tulapp-hosted services.
However, this is not guaranteed for every feature or configuration.
An outage of Tulapp-hosted services does not create an obligation for Tulapp to expose, disable or reconfigure a customer's underlying systems.
The Service may provide statistics, measurements, scores, comparisons, forecasts or estimates relating to matters such as performance, resource usage, security, compatibility or system behaviour.
Some values may be directly measured.
Others may be estimated, sampled, modelled or derived from baseline measurements.
Estimated figures are not exact measurements and should not be relied upon as guarantees of:
The Service may use automated analysis to identify technical characteristics, changes, potential risks, compatibility issues or recommendations.
Automated findings may contain errors, false positives or false negatives.
Users should review important findings before taking consequential action.
Tulapp processes personal data in accordance with applicable privacy and data-protection laws, including the General Data Protection Regulation ("GDPR") where applicable.

Acceptance of these Terms is not used as a substitute for consent where consent is legally required.
Depending on how the Service is used, Tulapp may act as:
Where legally required, processor activities will be governed by a separate Data Processing Agreement.
Tulapp aims to process only information reasonably necessary to provide, secure, improve and administer the Service.

Where such laws apply, the exclusions and limitations in these Terms apply only to the maximum extent permitted by applicable law.
Certain functionality may require a paid subscription or other payment arrangement.
Current pricing is published at tulapp.com/pricing. Applicable prices, billing periods, included functionality and renewal terms will be communicated before purchase, and the price for the upcoming renewal is shown before you pay.
Paid subscriptions are billed annually and renew automatically at the end of each billing period unless cancelled before the renewal date. See the Refund and Cancellation Policy for how to cancel and what happens to your access afterwards.
Payments are processed by Mollie B.V., an independent third-party payment service provider — see section 30 and the Privacy Policy.
Functionality associated with a subscription may change over time as the Service evolves, subject to applicable law and any specific contractual commitments made at purchase.
When a paid service expires or is cancelled, access to subscription-dependent functionality may end. Cancelling stops future renewal only — access already paid for continues until the end of the current paid period; see the Refund and Cancellation Policy for the full detail.
Tulapp will not intentionally make an already deployed customer's website unavailable solely because a subscription expires.
However, functionality that relies on ongoing hosted services, remote services, intelligence, monitoring, updates or similar subscription-dependent resources may no longer be available.
You remain responsible for maintaining appropriate local access and recovery capabilities.
Tulapp may develop and change the Service continuously.
This may include:
Tulapp may also release experimental, beta or preview features.
Material changes to paid services will be handled reasonably and in accordance with applicable law.
Some functionality may be identified as:
Such functionality may be less stable, less tested or subject to greater change.
You should use additional caution and maintain appropriate backups when using such features.
The Service may interact with third-party software and services, including Mollie B.V., our payment service provider, which processes payments on Tulapp's behalf. Tulapp does not collect or store your card or bank details — see the Privacy Policy.

Security-related functionality may only be used against systems you own or are authorised to manage or test.
Tulapp and its licensors retain all intellectual-property rights in the Service except for third-party components governed by their own licences.
You receive a limited, non-exclusive and non-transferable right to use the Service in accordance with these Terms and any applicable subscription or licence.
No ownership rights are transferred.
The Service may contain open-source software.
Open-source components remain subject to their applicable licence terms.
Where an open-source licence grants rights that differ from these Terms, that licence governs the relevant component.
Information, scores, recommendations and automated findings provided by the Service are technical information only.
They do not constitute:

To the fullest extent permitted by applicable law, Tulapp's total aggregate liability arising out of or relating to the Service is limited to the amount paid by the customer to Tulapp for the affected Service during the 12 months preceding the event giving rise to the claim.
For free Services, liability is limited, to the fullest extent permitted by law, to EUR 100.
This limitation does not apply where applicable law does not permit liability to be excluded or limited.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by mandatory law.
This includes liability that cannot legally be excluded for matters such as intentional misconduct, fraud or other non-excludable liability.
If you use the Service for business or professional purposes, you agree, to the extent permitted by law, to indemnify Tulapp against third-party claims resulting from:
This does not apply to the extent the claim is caused by Tulapp's own legally attributable conduct.
Tulapp is not liable for failure or delay resulting from events reasonably beyond its control, including:

You are responsible for understanding and, where necessary, reversing or replacing any local configuration before discontinuing the Service.

Where required by law, Tulapp will provide notice of material changes or request renewed acceptance.

Failure to enforce a provision does not constitute a waiver of that provision or any other right.
Business users may not transfer their contractual rights or obligations without Tulapp's prior written consent unless applicable law provides otherwise.
Tulapp may transfer the agreement in connection with a merger, acquisition, restructuring or transfer of the relevant business, subject to applicable law.
These Terms and the contractual relationship between you and Tulapp are governed by the laws of the Netherlands, excluding conflict-of-law rules, unless mandatory law requires otherwise.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
The choice of Dutch law does not deprive consumers or other protected parties of mandatory rights that apply to them under the laws of their country of residence and cannot legally be waived.
For business users, disputes relating to these Terms or the Service shall be submitted to the competent court in the Netherlands serving Grote Sparrenlaan 3, 2121 CZ Bennebroek, The Netherlands, the registered location of ClickSmash B.V., unless mandatory law provides otherwise.
Consumers retain any jurisdictional rights provided by mandatory law.
These Terms may be translated.
Unless applicable law requires otherwise, the English version is the primary version.
Where legally permitted, the English version prevails in the event of inconsistency.
